1. Introduction and Acceptance

These Terms and Conditions (“Terms”) govern your access to and use of the website located at https://pluginsbuy.com (the “Website”) and all products and services offered through the Website (collectively, the “Services”), operated by APSARA TRADING – F.Z.E. (“Company,” “we,” “us,” “our”), a free zone establishment duly incorporated and licensed under the laws of the United Arab Emirates.

By accessing the Website, creating an account, or purchasing any product, you (“Customer,” “you,” “your”) confirm that you:

  1. Have read, understood, and agree to be bound by these Terms in their entirety;
  2. Are at least 18 years of age or have reached the age of majority in your jurisdiction;
  3. Have the legal capacity and authority to enter into a binding agreement.

If you do not agree to these Terms, you must immediately cease using the Website and Services. We reserve the right to update these Terms at any time. Continued use of the Website after such changes constitutes your acceptance of the revised Terms.

2. Definitions

For the purposes of these Terms:

  • “Plugin(s)” means the WordPress software plugins and related digital products sold on the Website, developed and owned by APSARA TRADING – F.Z.E.
  • “License” means the non-exclusive, non-transferable, limited right to use a Plugin as set out in the End User License Agreement (EULA).
  • “Order” means a purchase transaction completed on the Website.
  • “License Key” means the unique alphanumeric code delivered to you upon purchase, required to activate and use a Plugin.
  • “Support Period” means the six (6) month period following the date of purchase during which bug-fix support is available.
  • “Renewal” means a subsequent payment made to extend or continue access to updates, downloads, or support beyond the initial purchase period.
  • “Intellectual Property Rights” means all patents, copyrights, trade marks, trade secrets, database rights, and all other intellectual property rights, whether registered or unregistered, anywhere in the world.

3. Products and Eligibility

3.1 Products

PluginsBuy sells proprietary WordPress plugins developed by APSARA TRADING – F.Z.E. All Plugins are digital goods delivered electronically via a License Key and download link provided to your registered email address following successful payment.

3.2 Eligibility

You must be 18 years of age or older to make a purchase. By completing a purchase, you represent and warrant that you meet this requirement. Purchases must be made for lawful purposes only and in compliance with these Terms.

3.3 Business Customers

If you are purchasing on behalf of a company or legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

4. Account Registration

To purchase Plugins, you may be required to create an account on the Website. You agree to:

  • Provide accurate, current, and complete information during registration;
  • Maintain and promptly update your account information;
  • Keep your account password confidential and not share it with third parties;
  • Accept responsibility for all activities that occur under your account;
  • Notify us immediately at contact@pluginsbuy.com if you suspect unauthorised use of your account.

We reserve the right to suspend or terminate accounts that contain inaccurate information, have been inactive for an extended period, or are associated with a breach of these Terms.

5. Orders and Payment

5.1 Placing Orders

By placing an Order on the Website, you are making a binding offer to purchase the selected Plugin(s) subject to these Terms. An Order is confirmed, and a contract formed between you and APSARA TRADING – F.Z.E., upon receipt of our order confirmation email and successful processing of payment.

We reserve the right to refuse or cancel any Order at our sole discretion, including where:

  • Payment cannot be processed or is fraudulent;
  • A pricing error has occurred on the Website;
  • The product is unavailable.

5.2 Pricing

All prices displayed on the Website are in USD (United States Dollars) unless otherwise stated. Prices are exclusive of applicable taxes unless stated otherwise. We reserve the right to change prices at any time; however, such changes will not affect Orders already confirmed.

5.3 Payment Processing

All payments are processed securely by Stripe, Inc. We accept the payment methods displayed at checkout. By providing payment details, you represent and warrant that you are authorised to use the payment method and that the information provided is accurate.

We do not store your full payment card details. All cardholder data is handled by Stripe in accordance with PCI-DSS standards.

5.4 Taxes and Duties

You are solely responsible for any applicable taxes, duties, or levies imposed by your country, state, or local jurisdiction in connection with your purchase. Where applicable, Value Added Tax (VAT) or equivalent indirect taxes may be added to your Order at checkout.

6. Digital Delivery

Upon successful payment, your License Key and download link will be delivered to the email address associated with your account. Delivery is typically immediate but may take up to 24 hours in exceptional circumstances. If you do not receive your license within this period, please contact us at contact@pluginsbuy.com.

You are responsible for ensuring your email address is correct and capable of receiving our communications. We are not liable for failed delivery caused by an incorrect email address, spam filters, or other factors outside our control.

7. License

Your use of any Plugin is governed by our End User License Agreement (EULA), which is incorporated into these Terms by reference. A copy of the EULA is available on the Website and is provided to you at the time of purchase.

In summary, each Plugin purchase grants you a non-exclusive, non-transferable, limited license to install and use the Plugin on the number of websites specified in your Order. You may not sublicense, sell, resell, transfer, redistribute, or otherwise make the Plugin available to any third party.

8. Technical Support

8.1 Support Scope

We provide technical support for a period of six (6) months from the date of purchase. Support is limited strictly to:

  • Identifying and fixing software bugs (defects that cause the Plugin to malfunction contrary to its documented specifications);
  • Resolving errors caused by the Plugin’s own code.

8.2 Exclusions from Support

The following are expressly excluded from our support obligations:

  • New feature requests or feature enhancements;
  • Customisation, modification, or bespoke development of any kind;
  • Issues arising from your WordPress theme, other plugins, or third-party software conflicts;
  • Issues caused by your modifications to the Plugin code;
  • General WordPress or hosting support;
  • Support requested after the expiry of the six (6) month Support Period, unless you have a valid active renewal.

8.3 How to Request Support

Support requests must be submitted to contact@pluginsbuy.com and must include: (i) your order number; (ii) the Plugin name; (iii) a detailed description of the issue; and (iv) steps to reproduce the bug.

We will endeavour to respond to support requests within 3–5 business days, though response times are not guaranteed and are not subject to any service level agreement.

9. Renewals

9.1 Optional Renewals

Continued access to Plugin updates and technical support beyond the initial period may require a Renewal payment. Renewal terms, pricing, and availability are displayed on the Website and/or your account dashboard.

9.2 No Refunds on Renewals

Renewal payments are strictly non-refundable. By completing a Renewal, you acknowledge that you have reviewed the current terms and that no refund will be issued under any circumstances for Renewal payments. Please refer to our Refund Policy for details.

10. Refund Policy

Our Refund Policy is set out in full in the separate Refund Policy document available on the Website, which is incorporated into these Terms by reference.

In summary: We offer a 14-day refund window for initial Plugin purchases. Refund requests must be submitted by email to contact@pluginsbuy.com and must include the Plugin name, order number, and registered email address. Renewals are non-refundable.

11. Intellectual Property

11.1 Ownership

All Plugins, software, source code, documentation, design, trade marks, logos, graphics, and other content on the Website are the exclusive intellectual property of APSARA TRADING – F.Z.E. and are protected by applicable UAE and international intellectual property laws, including copyright, trade mark, and trade secret laws.

11.2 Restrictions

You must not, without our prior written consent:

  • Copy, reproduce, reverse engineer, decompile, disassemble, or attempt to derive the source code of any Plugin;
  • Modify, adapt, translate, or create derivative works based on any Plugin;
  • Remove or alter any copyright, trade mark, or proprietary notices from any Plugin or documentation;
  • Use our trade marks, logos, or branding in any manner that suggests affiliation with or endorsement by APSARA TRADING – F.Z.E.;
  • Sublicense, sell, resell, rent, lease, or otherwise transfer rights to any Plugin.

11.3 Feedback

If you provide us with feedback, suggestions, or ideas regarding our Plugins or Website, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use, incorporate, and exploit such feedback without restriction or compensation to you.

12. Prohibited Uses

You agree not to use the Website or Plugins to:

  • Violate any applicable law or regulation;
  • Infringe the intellectual property rights of any third party;
  • Transmit any harmful, offensive, defamatory, or unlawful content;
  • Engage in fraudulent transactions or provide false information;
  • Attempt to gain unauthorised access to our systems or those of third parties;
  • Interfere with or disrupt the operation of the Website or servers;
  • Use automated tools (bots, scrapers, crawlers) to collect data from the Website without our consent;
  • Engage in any activity that could damage our reputation or business.

We reserve the right to suspend or terminate your access to the Website and Services immediately and without notice for any violation of this clause.

13. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  • THE WEBSITE AND ALL PLUGINS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED;
  • WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY;
  • WE DO NOT WARRANT THAT THE PLUGINS WILL OPERATE ERROR-FREE, UNINTERRUPTED, OR FREE OF BUGS, OR THAT DEFECTS WILL BE CORRECTED;
  • WE DO NOT WARRANT THAT THE WEBSITE OR PLUGINS ARE COMPATIBLE WITH ANY PARTICULAR HARDWARE, SOFTWARE, OR HOSTING ENVIRONMENT.

Nothing in these Terms shall exclude or limit warranties that cannot be excluded under mandatory applicable law.

14. Limitation of Liability

14.1 Exclusion of Consequential Loss

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, APSARA TRADING – F.Z.E. SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY:

  • LOSS OF PROFITS, REVENUE, OR BUSINESS;
  • LOSS OF DATA OR CORRUPTION OF DATA;
  • INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND;

ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE WEBSITE, PLUGINS, OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

14.2 Cap on Liability

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS, THE WEBSITE, OR THE PLUGINS SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU FOR THE SPECIFIC PLUGIN GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE DATE OF THE CLAIM.

14.3 Exceptions

Nothing in these Terms shall limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

15. Indemnification

You agree to indemnify, defend, and hold harmless APSARA TRADING – F.Z.E. and its officers, directors, employees, agents, successors, and assigns from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use or misuse of the Website or Plugins;
  • Your breach of these Terms or the EULA;
  • Your infringement of any third-party rights, including intellectual property rights;
  • Your violation of any applicable law or regulation.

16. Third-Party Services and Links

The Website may contain links to third-party websites or integrate with third-party services (e.g., Stripe). We do not endorse, control, or accept responsibility for the content, privacy practices, or terms of any third-party website or service. Your use of third-party services is at your own risk and subject to their respective terms and conditions.

17. Modifications to the Website and Services

We reserve the right at any time and without notice to:

  • Modify, suspend, or discontinue the Website or any part thereof;
  • Modify or discontinue any Plugin, including its features;
  • Change the pricing for future purchases.

We shall not be liable to you or any third party for any such modifications, suspension, or discontinuation.

18. Force Majeure

We shall not be liable for any failure or delay in performance of our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, pandemic, government action, natural disaster, failure of internet or telecommunications infrastructure, or any other event of force majeure.

19. Governing Law and Dispute Resolution

19.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of laws principles.

19.2 Dispute Resolution

In the event of any dispute, the parties shall first attempt to resolve the matter amicably through good-faith negotiation for a period of 30 days from the date of written notice of the dispute.

If the dispute is not resolved through negotiation, it shall be referred to and finally resolved by the competent courts of the United Arab Emirates, which shall have exclusive jurisdiction.

19.3 Consumer Rights

Nothing in this clause shall affect the statutory rights of consumers as applicable under the mandatory laws of your jurisdiction.

20. Severability

If any provision of these Terms is held to be unlawful, void, or unenforceable for any reason, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.

21. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorised representative of APSARA TRADING – F.Z.E.

22. Entire Agreement

These Terms, together with the EULA, Refund Policy, Privacy Policy, and Cookie Policy, constitute the entire agreement between you and APSARA TRADING – F.Z.E. with respect to the subject matter hereof and supersede all prior negotiations, representations, warranties, and understandings.
