End User License Agreement (EULA)

IMPORTANT — PLEASE READ CAREFULLY

This End User License Agreement (“Agreement” or “EULA”) is a legally binding contract between you (“Licensee,” “you,” “your”) and APSARA TRADING – F.Z.E. (“Licensor,” “we,” “us,” “our”), the developer and owner of the WordPress plugins sold through https://pluginsbuy.com (the “Website”).

BY PURCHASING, DOWNLOADING, INSTALLING, ACTIVATING, OR OTHERWISE USING ANY PLUGIN, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS. IF YOU DO NOT AGREE, DO NOT PURCHASE, DOWNLOAD, INSTALL, OR USE THE PLUGIN.

1. Definitions

  • “Plugin” means the WordPress software plugin(s) licensed to you under this Agreement, including all associated documentation, source code (to the extent provided), updates, patches, and bug fixes.
  • “License Key” means the unique alphanumeric activation key issued to you upon purchase, required to activate and operate the Plugin.
  • “Permitted Website(s)” means the website(s) or domain(s) on which you are licensed to install and operate the Plugin, as specified in your Order.
  • “Order” means your confirmed purchase transaction on the Website.
  • “Renewal” means a subsequent payment to extend or continue your access to Plugin updates and support.
  • “Update” means a release of the Plugin that provides bug fixes, security patches, or minor enhancements within the same major version, delivered during the Support Period.
  • “Support Period” means the six (6) calendar months commencing on the date of your Order.
  • “Authorised Users” means you and, where applicable, your employees or contractors who access the Plugin solely on your behalf and in connection with your Permitted Website(s).

2. Grant of License

Subject to the terms of this Agreement and your payment of the applicable License fee, APSARA TRADING – F.Z.E. hereby grants you a:

  • Non-exclusive — the license does not prevent us from licensing the same Plugin to others;
  • Non-transferable — you may not assign or transfer this license to any third party;
  • Non-sublicensable — you may not grant sub-licenses;
  • Revocable — this license may be revoked in accordance with Section 11;
  • Limited — restricted to the scope expressly set out in this Agreement;

license to install, activate, and use the Plugin solely on the number of Permitted Website(s) specified in your Order, for your own internal business or personal purposes, during the term of this Agreement.

3. License Scope and Restrictions

3.1 Permitted Uses

You may:

  • Install and activate the Plugin on the Permitted Website(s) specified in your Order;
  • Use the Plugin in connection with the WordPress content management system on the Permitted Website(s);
  • Create and store a reasonable number of backup copies of the Plugin files for archival purposes only, provided such copies are not used on additional websites;
  • Allow Authorised Users to access and operate the Plugin on your behalf in connection with your Permitted Website(s).

3.2 Restrictions

You must not, and must not permit any third party to:

  1. Distribute, publish, resell, sublicense, rent, lease, lend, or otherwise transfer the Plugin or any rights in it to any third party;
  2. Reverse engineer, decompile, disassemble, or otherwise attempt to derive, reconstruct, or identify the source code, algorithms, or underlying structure of the Plugin, except to the extent that such activity is expressly permitted by applicable law notwithstanding this restriction;
  3. Modify, translate, adapt, or create derivative works based on the Plugin, except as expressly authorised by us in writing;
  4. Remove, alter, obscure, or circumvent any copyright notice, trade mark, license key mechanism, or other proprietary rights notice incorporated in or accompanying the Plugin;
  5. Use the Plugin on more websites or domains than specified in your Order without purchasing an appropriate additional license;
  6. Use the Plugin for any unlawful purpose or in violation of any applicable law or regulation;
  7. Share, publish, or distribute your License Key or allow any third party to use your License Key;
  8. Use the Plugin to develop a competing product or service;
  9. Repackage or rebrand the Plugin as your own product, whether for sale or free distribution.

4. Ownership and Intellectual Property

The Plugin, including all copies, modifications, enhancements, and derivative works thereof (whether or not authorised), and all Intellectual Property Rights therein, remain the sole and exclusive property of APSARA TRADING – F.Z.E.

This Agreement does not convey to you any ownership interest in the Plugin. You receive only the limited right to use the Plugin as expressly set out in this Agreement.

All trade marks, service marks, logos, and trade names associated with PluginsBuy and the Plugins are owned by or licensed to APSARA TRADING – F.Z.E. You acquire no rights in any of the foregoing.

5. License Key

Your License Key is unique to your Order and activates the Plugin on your Permitted Website(s). You must:

  • Keep your License Key confidential and secure;
  • Not share, publish, or transfer your License Key to any third party;
  • Use your License Key only to activate the Plugin on your Permitted Website(s).

We reserve the right to revoke any License Key that we reasonably believe has been shared, transferred, or used in breach of this Agreement, without refund.

6. Updates and Bug Fix Support

6.1 Support Period

We will provide bug fix support and Plugin Updates for a period of six (6) calendar months from the date of your Order (the “Support Period”).

6.2 Scope of Support

During the Support Period, support is strictly limited to:

  • Bug fixes: Correcting defects in the Plugin’s code that cause it to malfunction contrary to its documented specifications;
  • Error resolution: Addressing crashes, fatal errors, or critical functional failures attributable to the Plugin’s own code.

6.3 Exclusions

The following are expressly excluded from support:

  • New features or enhancements — we are under no obligation to develop or deliver new functionality;
  • Customisation or modification of any kind — bespoke development, theme integration, or code adjustments to suit your specific requirements;
  • Third-party conflicts — issues arising from incompatibilities with your theme, other plugins, server environment, or third-party services (unless caused by a bug in the Plugin itself);
  • User error — problems resulting from incorrect installation or configuration;
  • Issues caused by your modifications to the Plugin code;
  • General WordPress, hosting, or server support.

6.4 How to Request Support

Submit support requests by email to contact@pluginsbuy.com, including: (i) your Order number; (ii) Plugin name; (iii) a detailed description of the issue; and (iv) steps to reproduce. We endeavour to respond within 3–5 business days.

6.5 Extended Support via Renewal

You may extend your access to Updates and support beyond the initial Support Period by purchasing a Renewal. Renewal pricing is available on the Website.

7. Third-Party Components

The Plugin may include open-source software components or third-party libraries. Where applicable, such components are used under their respective open-source licenses (e.g., MIT, Apache 2.0, GPL). A list of any such third-party components and their respective licenses may be provided in the Plugin documentation.

Such third-party licenses do not limit the restrictions applicable to the Plugin as a whole under this Agreement.

8. Warranty Disclaimer

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PLUGIN IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. APSARA TRADING – F.Z.E. SPECIFICALLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE;
  • WARRANTIES THAT THE PLUGIN WILL OPERATE WITHOUT INTERRUPTION OR BE ERROR-FREE;
  • WARRANTIES OF NON-INFRINGEMENT;
  • WARRANTIES THAT DEFECTS WILL BE CORRECTED.

YOU ACKNOWLEDGE THAT SOFTWARE PRODUCTS ARE INHERENTLY COMPLEX AND MAY CONTAIN DEFECTS. YOUR SOLE REMEDY FOR ANY DEFECT IS BUG FIX SUPPORT AS PROVIDED IN SECTION 6 OR A REFUND IN ACCORDANCE WITH THE REFUND POLICY.

Nothing in this section shall exclude warranties that cannot be excluded under the mandatory laws of your jurisdiction.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  • IN NO EVENT SHALL APSARA TRADING – F.Z.E. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR YOUR USE OF OR INABILITY TO USE THE PLUGIN;
  • OUR TOTAL LIABILITY TO YOU UNDER OR IN CONNECTION WITH THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE PLUGIN GIVING RISE TO THE CLAIM.

These limitations apply regardless of the legal theory under which liability is asserted (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Nothing in this Agreement shall limit liability for fraud, wilful misconduct, or any other liability that cannot be limited under applicable law.

10. Term and Termination

10.1 Term

This Agreement commences on the date of your Order and continues until terminated in accordance with this Section.

10.2 Termination by You

You may terminate this Agreement at any time by uninstalling the Plugin from all Permitted Website(s) and destroying all copies. Termination by you does not entitle you to a refund beyond our Refund Policy.

10.3 Termination by Us

We may terminate this Agreement and revoke your License Key immediately upon written notice (including email) if:

  • You breach any term of this Agreement and fail to remedy the breach within 7 days of receiving notice;
  • You breach Sections 3.2 (Restrictions) or 5 (License Key), which are deemed incapable of remedy;
  • You become insolvent, bankrupt, or subject to receivership or administration.

10.4 Effect of Termination

Upon termination, you must immediately:

  • Uninstall and remove the Plugin from all websites and systems;
  • Destroy all copies of the Plugin in your possession or control;
  • Cease any and all use of the Plugin.

Termination does not affect any accrued rights or remedies of either party. Sections 4, 8, 9, 12, and 13 survive termination.

11. Governing Law

This Agreement and any dispute or claim arising out of or in connection with it shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes not resolved amicably shall be subject to the exclusive jurisdiction of the competent courts of the United Arab Emirates.

12. General

  • Entire Agreement: This EULA, together with the Terms and Conditions, Refund Policy, and Privacy Policy, constitutes the entire agreement between the parties with respect to the Plugin and supersedes all prior agreements and understandings.
  • Severability: If any provision of this Agreement is found invalid or unenforceable, the remaining provisions continue in full force.
  • No Waiver: Failure to enforce any provision does not constitute a waiver of the right to do so in the future.
  • Updates to this EULA: We may update this EULA from time to time. The EULA in effect at the time of your Order governs your license. Material changes will be communicated via the Website.
  • Language: This Agreement is made in English. Any translations are for convenience only; the English version prevails in the event of any conflict.
